Terms and Conditions of Use

Introduction

These Terms and Conditions of Use (hereinafter referred to as "Terms of Use"), together with the Privacy and Cookie Policy (collectively, the "Terms and Conditions"), govern:

• Access to and use of the BAILATIX website and its associated sub-pages hosted under the www.bailatix.com domain,
• Registration and account creation on the website as an individual or commercial user,
• The purchase of tickets for events organized by users.

and regulate the same.

Users are required to read this document carefully. No provision of these Terms and Conditions shall create any relationship of employment, agency, or partnership between the parties.

1. Identity of the Platform Owner

This website is operated by the following individual/entity:

By accessing or using the website, the User acknowledges that they have read and accepted these Terms and Conditions.

2. General Information

The website created by BAILATIX offers Users a tool to organize events and purchase tickets. These services will be referred to as "Event Organization Service" and "Ticket Purchase Service" respectively, and collectively as "Services".

Through these Services, Users wishing to organize events (hereinafter referred to as "Organizers") can publish their own events (hereinafter referred to as "Events") on the website and sell tickets to other Users (hereinafter referred to as "Buyers").

To use the Services on the website, Users must be at least 18 years old or have obtained the consent of their legal representatives. The User declares that they meet these conditions.

The User is solely responsible for the accuracy of the data provided to BAILATIX through registration forms and reservation processes.

Accounts created by bots or automated methods are not permitted.

3. Event Organization Service

3.1 Description

Organizers can access the Event Organization Service via the "Business Account Area" (hereinafter referred to as "Business Area") created for this purpose on the website.

BAILATIX acts solely as an intermediary in ticket sales between Organizers and Buyers. It manages the distribution of tickets on behalf of and for the account of the Organizer. BAILATIX under no circumstances holds the title of event organizer and accepts no organizational responsibility at any stage of the events.

BAILATIX grants temporary access and usage rights to the Business Area; under no circumstances does this right imply the transfer of intellectual or industrial property rights.

3.2 How to Create an Event?

Organizers must first create a Business Account. To do this, they must fill out the registration form on the website (hereinafter referred to as the "Business Registration Form") and accept the Terms and Conditions.

Once the Business Account is activated, Organizers can register their events; through the dashboard enabled for each event, they can edit event details (location, date, ticket prices, etc.) and manage ticket sales.

A separate Service Agreement will be signed between the Parties for each event.

3.3 Obligations of the Organizers

BAILATIX undertakes the following towards the Organizers:

• To keep the Business Area active at all times
• To provide the Organizer with anonymized statistics regarding users' access to their events
• To display correct and accurate information on the website
• To maintain separate accounts and transaction records for each Organizer

Organizers, in turn, undertake the following towards BAILATIX:

• To keep the Business Account up to date at all times (including personal, banking, and other data)
• To possess all intellectual and industrial property rights, image rights, and necessary licenses regarding the published content
• Not to use BAILATIX's logo and distinctive signs without the express written permission of BAILATIX

Creating a Business Account and publishing events is free of charge; the commission structure is separately regulated in the Service Agreement.

3.4 Rights Regarding Content Provided by Organizers

By publishing content on the website, the Organizer agrees to grant BAILATIX a non-exclusive, royalty-free license to use this content solely for the purpose of the website.

The Organizer declares and warrants that all content they provide complies with the Terms and Conditions.

3.5 Prohibition on Organizing Lotteries and Competitions

BAILATIX is not a lottery or competition platform. The User agrees not to organize or publish any event of this nature. BAILATIX reserves the right to remove events violating this provision without prior notice.

3.6 Security and Fraud Prevention

In the event of fraud, fake transactions, or identity theft detection, the situation will be reported to the competent authorities within the scope of the Turkish Penal Code No. 5237 and relevant legislation. BAILATIX will cooperate with authorized institutions in the prosecution of such offenses.

4. Ticket Purchase Service

4.1 Description

BAILATIX offers a Ticket Purchase Service providing Users with a fast and easy way to purchase tickets for events.

4.2 How to Purchase Tickets?

1. The Buyer selects the event they wish to attend.
2. The Buyer determines the ticket type and quantity, then clicks the "Proceed" button.
3. The Buyer fills out the Buyer Registration Form and explicitly approves the Privacy Policy and the Terms and Conditions.
4. If required, the Buyer enters participant information and agrees that this information will be shared with the Organizer.
5. The Buyer selects the payment method and completes the payment transaction.
6. BAILATIX sends a Purchase Confirmation to the registered e-mail address.
7. The Buyer can download and print their tickets.

If payment is made in a currency other than Turkish Lira (TRY), the exchange rate is determined by the payment processor.

4.3 Payment Methods

Available payment methods will be clearly indicated during the purchase process.

All payments are processed independently through third-party payment service providers. BAILATIX does not collect any payment information, such as card details; it only receives notification that the payment has been successfully completed.

If the payment is rejected by the payment service provider, the Buyer's obligation to purchase terminates. Any costs arising from failed payments shall belong to the Buyer.

4.4 Access to the Event

The Buyer can attend the event by presenting their printed or digital ticket at the entrance. Even if multiple copies are printed, only the ticket presented first is valid; subsequent entries with the same ticket will not be permitted.

Admission to and exit from the venue are subject to the policies determined by the Organizer and the venue owner.

4.5 Ticket Conditions of Use

• Tickets are issued in accordance with the Organizer's rules; in case of violation, the holder may be removed from the event without a refund.
• Illegal resale or attempt thereof constitutes grounds for cancellation without compensation.
• Tickets may not be used for commercial or promotional purposes without prior express permission.
• The event may be recorded for commercial purposes. Attendance implies consent to your image being recorded as an audience member.
• BAILATIX is not responsible for visibility, sound, accessibility, security, or other organizational elements. All such responsibilities belong to the Organizer.
• Tampered, damaged, or counterfeit tickets will be deemed invalid.
• BAILATIX cannot be held responsible for lost or stolen tickets.

4.6 Right of Withdrawal and Refund Policy

In accordance with the Law No. 6502 on Consumer Protection and the Distance Contracts Regulation; there is no right of withdrawal for purchases relating to leisure services such as events, entertainment, festivals, workshops, courses, and similar activities to be performed on a specific date.

Refunds are not accepted under the following circumstances:

• The Buyer's inability to attend the event
• Errors made during purchase (such as entering the wrong e-mail address)
• Adverse weather conditions
• Minor changes or non-essential rescheduling made by the Organizer

Refunds are accepted under the following circumstances:

• Total cancellation or suspension of the event by the Organizer (see Article 4.7)

For approved refunds, only the ticket price will be refunded. The following are non-refundable under any circumstances:

• Platform and administration fees
• Distribution fees
• Additional service fees related to the purchase

If the event is suspended after more than 50% of its duration has elapsed, no right to a refund arises.

4.7 Changes and Refunds

In the event that the event is completely cancelled or suspended by the Organizer, a refund of the ticket price will be accepted.

Date, venue, or artist changes are entirely the responsibility of the Organizer. BAILATIX acts solely as a distribution intermediary.

In case of cancellation, BAILATIX manages and executes refunds on behalf of and for the account of the Organizer under the following conditions:

• When the cancellation becomes official, without requiring additional authorization from the Organizer
• In case of technical issues, duplicate registrations, or a clear billing error

Refunds:

• Are made only for the ticket price
• Administration fees or additional services are excluded from the scope of the refund
• Are carried out using the payment method used by the Buyer
• Are completed within approximately 15 business days from the official announcement of the cancellation decision

4.8 Liability

BAILATIX acts solely as an intermediary between Organizers and Buyers. In this context:

• It assumes no responsibility if the event does not take place; all claims must be directed to the Organizer.
• Complaints regarding the quality, execution, or organization of the event must be directed exclusively to the Organizer.

5. Account Cancellation

Users can cancel their accounts through the following methods:

• Via the account management tools on the website
• By sending an e-mail to info@bailatix.com

6. Use of the Website

The User agrees that they use the website at their own risk and responsibility. BAILATIX is not responsible for any use of the website that is contrary to the Terms and Conditions, incorrect, or abusive.

Users are fully responsible for using the website in accordance with applicable Turkish legislation, international regulations, and the principles of good faith, morality, and public order.

BAILATIX does not guarantee that the website services will always function uninterruptedly, error-free, or virus-free. BAILATIX is not responsible for any damage or errors that may result from virus infection of the User's computer systems.

In any case, BAILATIX is liable for damages arising from its own malicious or clearly negligent actions; however, it cannot be held responsible for technical malfunctions beyond this scope.

7. Conduct Restrictions

The following behaviors are strictly prohibited:

• Acting as if of legal age when a minor
• Impersonating someone else or representing them without authorization
• Manipulating identifiers in order to disguise the origin of content
• Defaming, harassing, or threatening others
• Sharing content that encourages suicide, self-harm, illegal drug use, or excessive alcohol consumption
• Subjecting the website to vulnerability testing or attempting to bypass security measures
• Uploading malicious software or attempting to disrupt the system
• Sending spam or excessively utilizing the technical infrastructure
• Scraping data through automated methods without the express permission of BAILATIX
• Publishing illegal, obscene, or defamatory content
• Making posts containing hate, racism, discrimination, pornography, or violence
• Distributing content that violates intellectual property rights
• Publishing content containing personal data or confidential information that violates third-party rights
• Engaging in any activity that would disrupt the integrity of the website or the experience of other users

8. Links to Third Parties

BAILATIX is not responsible for the content of third-party links on the website and reserves the right to remove these links without prior notice. Users who believe that any link is contrary to the law or public morality may notify info@bailatix.com.

9. Access to External Resources

BAILATIX has no control over the content and availability of third-party resources accessible through the website. The terms of such resources are subject to the respective third parties' own terms and conditions.

10. Intellectual and Industrial Property

BAILATIX is the owner or licensee of all intellectual and industrial property rights on the website. Users' access to the website does not imply the transfer or permission to use these rights.

Organizers guarantee that they possess all intellectual and industrial property rights regarding the content they upload to the website; they grant BAILATIX a non-exclusive, geographically unrestricted, and perpetual license to publish this content on the website.

11. Closure of User Account and Suspension of Service

BAILATIX reserves the right to remove or suspend the account of Users who do not comply with the Terms and Conditions or the Privacy Policy without prior notice.

Suspension or deletion of the account due to reasons originating from the User or Organizer:

• Does not grant the User any right to claim compensation, damages, or refunds.
• Does not eliminate the obligation to pay applicable fees and commissions.

12. Changes to the Terms and Conditions

BAILATIX reserves the right to change the Terms of Use at any time in accordance with the legislation in force. Changes will be announced on the website; Users are advised to regularly review the current terms.

13. Applicable Legislation

These Terms of Use have been prepared in accordance with the applicable Turkish legislation, particularly the following regulations:

• Law No. 6563 on the Regulation of Electronic Commerce
• Law No. 6502 on Consumer Protection and the Distance Contracts Regulation
• Personal Data Protection Law No. 6698 (KVKK)
• Law No. 5651 on the Regulation of Publications on the Internet
• Turkish Code of Obligations No. 6098
• Turkish Penal Code No. 5237 (relevant provisions)

14. Applicable Law and Jurisdiction

These Terms and Conditions shall be interpreted and applied in accordance with Turkish law.

In cases where the User acts as a consumer, applications can be made to consumer arbitration committees and consumer courts within the scope of Law No. 6502 for disputes.

Consumer Arbitration Committee monetary limits (as of the year 2025):

In disputes of a commercial nature, the Courts and Enforcement Offices of the province where the platform operator is located shall have jurisdiction.
